Buying a Nzmaps.co.nz map

We now sell the right to use the street map images so that you can place them on your web site, and for limited printing runs as described in the the following licence .

Each map image is a 1km by 1km square and you will need 9 adjacent ones to create the map page you see on nzmaps. The quality of the images are: indexed 256 colour (8-bit), 171 pixels wide and 170 pixels high, with a resolution of 96 pixels/inch and a file size of approx 29k. They are supplied in .gif format.

The prices are:

	a single tile costs NZ$100,
	for 5 or more single non-contiguous tiles purchased at the same time you receive a 10% reduction,
	for 9 contiguous tiles (3x3) the price is $800,
	for 16 contiguous tiles (4x4) the price is $1300, and
	for 25 contiguous tiles (5x5) the price would be $2200
	if you desire more than 25 contiguous tiles, or any higher quality then please e-mail us with your request.

An annual renewal fee of 50% of the original fee will be payable one year in advance.

The above prices allow you to print 100 copies of the map images. For any more than this the following fee structure applies:

	For 101 to 500 copies add 10%
	For 501 to 1500 copies add 20%
	For 1501 to 5000 copies add 30%
	For 5001 to 10,000 copies add 50%
	For over 10,000 add 60%

Now read the licence agreement for use of nzmap.co.nz map tiles (the data) on a third party internet site, or printed material.

BY USING THE DATA WHICH HAS BEEN OR WILL BE PROVIDED TO YOU YOU ARE INDICATING YOUR ACCEPTANCE OF THIS LICENCE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS AS STATED, YOU MAY NOT USE THE DATA.

Agent	For the purpose of this agreement nzmaps is acting on behalf of Terralink NZ Limited. (Terralink)
Rights:	This Licence Agreement is between You and nzmaps. This Licence Agreement gives You certain limited rights to use the Data and any Technical Information also provided. All rights not specifically granted in this Agreement are reserved to Terralink.
Reservation of ownership and grant of licence:	Terralink retains exclusive ownership of the Data and hereby grants to you a personal, non-exclusive, non-transferable licence to use the Data on the terms and conditions of this Agreement. You agree to use all reasonable efforts to protect the Data from unauthorised use, reproduction, distribution or publication.
Copyright:	The copyright in the Data belongs to Terralink. Nothing in this Agreement shall be construed as constituting a partnership between Terralink or nzmaps, and You.
Permitted uses:	You may use the Data only on a single internet site.
Printed Output:	You may produce printed output from the Data free of charge up to a maximum of 100 copies. You may print larger numbers of copies from the Data up to the maximum number covered by the copyright fee paid. All printed output produced from the Data should incorporate the following acknowledgements: Each copy must acknowledge that the material is copyright to Terralink Ltd. for the date for which the license fee has been paid.
Uses not permitted:	You may not sell, rent, lease, sublicence, lend, assign, time-share, or transfer, in whole or in part, or provide unlicensed Third Parties access to the Data or rights under this Agreement. You may not remove or obscure copyright notices.
Termination:	The Agreement will automatically terminate without notice if You fail to comply with any provision of this Agreement. On termination of this Agreement you will return the Data to your supplier and remove any whole or partial copies of the Data or its data from any computer systems that you know, or reasonably expect, contain copies.
Limited Warranty	The data is provided as is, and any use you make of it for whatever purpose is your responsibility. NZmaps does not warranty that the service will be available, uninterrupted, timely and not contain errors, nor does NZmaps warrant that the quality of the Data will meet your expectations. Some jurisdictions do not allow the exclusion of implied warranties so this may not apply to you in part of in full.
Disclaimer	Terralink and nzmaps give no warranty or undertaking as to the suitability of the Data for your purposes. While every effort is made to keep the Data up-to-date, we will not be responsible for any loss, damage or inconvenience caused by inaccuracies in the Data.
You acknowledge	You acknowledge that if you are dissatisfied with any part of the service, or with the Data, or with these Terms of Service your only remedy is to cease using the service and you agree to indemnify NZmaps, its affiliates, officers and employees harmless from any claim, demand, or damage, due to, or arising out of your use of the service or Data.
Amendments to these Terms and Conditions	NZmaps reserves the rights to change or amend these Terms of Service as and when they see fit. The only requirement for notifying you of these changes is to publish them on the website.
Applicable Law:	The interpretation of this agreement is controlled by the laws of New Zealand and any dispute relating to this agreement shall be subject to the jurisdiction and venue of these courts. The interpretation of this agreement expressly excludes the U.N. Convention of Contracts for the International Sale of Goods.
